Terms of Service

These terms apply to sleepybabydoctor.com and to the sleep plans we provide. By buying or using our service, you agree to them. Please read them — they are short on purpose.

1. Who we are

Sleepy Baby is operated by BrainCode Sp. z o.o., ul. Floriańska 6/2, 03-707 Warszawa, Poland (KRS 0000593431, NIP 5911697936, REGON 363299800). “We”, “us” and “our” refer to BrainCode Sp. z o.o.

2. Who sells you the plan

Our order process is conducted by our online reseller Paddle.com. Paddle.com Market Ltd is the merchant of record for all our orders. Paddle handles payment, billing enquiries, tax and refunds, and their own terms apply to the transaction itself. Charges appear on your statement as PADDLE.NET* SLEEPYBABY.

3. What you are buying

You are buying a personalised sleep plan and a fixed, prepaid period of active support — one week, four weeks or twelve weeks, depending on the option you choose at checkout.

This is a one-time payment. It is not a subscription. Nothing renews automatically and you will not be charged again unless you choose to buy another period.

During your active period, your plan is recalculated daily from the answers you give us each morning, and adjusted as your baby moves through the age bands that change their wake windows.

When your active period ends, daily recalculation and age-based adjustment stop. Your plan itself stays yours. Your most recent schedule, your night-time protocol and your situational guidance remain available to view in your account indefinitely.

4. Who can buy

You must be at least 18 years old and able to enter a contract where you live.

The plan is intended for a parent or guardian of the child it is built for. It is for your personal use only. You may share it with the child’s other parent, guardian or caregiver. You may not resell it, publish it, or distribute it.

5. Your account and access

We create an account for you using the email address you give us during the quiz. There is no password. To sign in, you ask for a link and we email it to you — the link signs you in and then expires.

This means your email address is your access. Please make sure the one you give us is correct and one you will keep. If you lose access to it, write to contact@sleepybabydoctor.com and we will help you move your plan to a new address.

Your plan is also emailed to you after purchase, so you have a copy that does not depend on signing in.

Do not share your sign-in links. Anyone who has one can see your plan.

6. What we store

To build and maintain your plan we store the answers you give us. About your child:

• their exact date of birth, and the age range you selected
• what time they wake in the morning and what time they fall asleep
• how many naps they take on a typical day and how long a typical nap lasts
• how long they take to settle at bedtime
• how many times they wake at night, and what gets them back to sleep

We keep this for as long as your account exists, because your plan is recalculated against your baby’s age and current pattern as they grow — without it the service cannot work.

We do not ask for and do not store your child’s name, sex, photographs or health records.

We also store what you tell us about yourself — your age range, how much sleep you get, how your mornings feel, how often you feel depleted, what you have caught yourself doing lately, what you want back first and what is pushing you to sort this out now. The plan is built around your life as well as your baby’s, which is why we ask.

Alongside that we store your email address, your purchase record, and technical data about your visit — your IP address, browser, referring page and advertising identifiers. What we do with all of it, how long we keep it and how to get it deleted is set out in our Privacy Policy.

You can ask us to delete your account and everything in it at any time by writing to contact@sleepybabydoctor.com. See our Privacy Policy for detail.

7. Delivery

Access is delivered digitally, by email, immediately after payment.

If you have not received anything within an hour of paying, write to contact@sleepybabydoctor.com and we will fix it.

8. Your right to change your mind

Because your plan is digital content delivered immediately, by completing your purchase you ask us to begin delivery right away and acknowledge that you lose the statutory 14-day right of withdrawal available to consumers in the EU and UK once delivery has begun.

This does not affect your rights under our refund policy, which is more generous than the statutory minimum — see section 9.

9. Refunds

You can request a full refund within 30 days of your payment, for any reason, with no questions asked. Write to contact@sleepybabydoctor.com from the address you used at checkout, or reply to any email we sent you. Refunds are processed by Paddle and typically arrive within 5–10 business days.

10. This is not medical advice

Our plans are built from published guidance on infant wake windows and sleep duration, applied to the answers you give us. They are general information and educational content. They are not medical advice, not a diagnosis, and not a substitute for care from a qualified health professional.

We are not doctors, nurses, midwives or licensed sleep clinicians, and nothing we provide should be treated as clinical guidance.

Please speak to your pediatrician or another qualified professional before making changes to your child’s sleep if your baby was born prematurely, has reflux or any medical condition, or if you have any concern about their weight, feeding, breathing or development. If you believe your child needs medical attention, contact a doctor or emergency services — not us.

You remain solely responsible for decisions about your child’s care.

11. What we ask of you

Please give us accurate information. The plan is calculated from what you tell us — a wrong birth date or wake time produces a schedule that does not fit your child.

Please do not attempt to access our systems without authorisation, scrape or copy our content, or use the service for anything unlawful.

12. Our content

All content we provide — plans, schedules, protocols, text, design and software — belongs to us or our licensors. Buying a plan gives you a personal, non-transferable licence to use it for your own family. It does not transfer ownership of anything.

13. Changes and availability

We improve the service continuously and may change how it works. We will not reduce what you have already paid for during a period you have bought.

We aim to keep the service available but cannot guarantee uninterrupted access. If a fault on our side prevents you from using your plan for a meaningful part of your active period, write to us and we will extend it or refund you.

14. Limits on our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under the law that applies to you. Your statutory rights as a consumer are not affected.

Subject to that, our total liability to you in connection with the service is limited to the amount you paid us in the twelve months before the claim.

We are not liable for outcomes that depend on factors outside our control, including how a plan is followed, your child’s health, or results that differ from what you hoped for.

15. Ending access

You can stop using the service at any time. If you want your money back, see section 9.

We may suspend or end your access if you breach these terms, in which case we will refund any unused part of your active period unless the breach involved fraud or unlawful use.

16. Language

These terms are published in English. We may make translations available for convenience. If there is any conflict between a translation and the English version, the English version applies — except where the law of the country you live in requires otherwise.

17. Governing law

These terms are governed by Polish law. If you are a consumer, you keep the protection of any mandatory consumer law in the country where you live, and you may bring proceedings there.

EU consumers can also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.

18. Changes to these terms

We may update these terms. The version in force when you buy is the one that applies to your purchase. We will post the current version here with the date it was last updated.
